Illinois Requires Filing for Non-compliant Auto Policy Forms

On June 13, 2022, the Illinois Department of Insurance (DOI) issued Company Bulletin 2022-11 to all companies writing private passenger and commercial automobile insurance within the state.

According to the Bulletin, the DOI has become of aware of certain auto policies which limit the claim payments for rental reimbursement coverage to only collision losses. In order to comply with 215 ILCS 5/143(2), the DOI expects that rental reimbursement coverage be afforded to both comprehensive AND collision losses if those underlying coverages are present on the policy.

For auto insurers with non-compliant policy forms, the DOI is requiring a filing to remove this coverage limitation. The filing should be submitted through SERFF as soon as possible, but no later than October 1, 2022.
